Arbitration and transparency - implementation
Council officials commenced drafting an amendment to the NGL in late 2016 and a draft of the National Gas (South Australia) (Pipelines Access-Arbitration) Amendment Bill 2017 was released for public consultation on 25 January 2017. The draft Amendment Bill was agreed by Council on 17 February 2017 and tabled in the South Australian Parliament on 29 March 2017. The Amendment Bill passed the South Australian House of Assembly on 17 May 2017 and the South Australian Legislative Council on 20 June 2017. The Act was proclaimed on 1 August 2017 and became operational on proclamation.
In June 2017, the GMRG undertook a public consultation process on the draft initial National Gas Rules (NGR) implementing the final design of the information disclosure and arbitration framework.
Following receipt of stakeholder feedback, the GMRG developed the final initial rules. In accordance with the COAG Energy Council’s direction that the framework commence by 1 August 2017, the initial rules were agreed by Energy Ministers out-of-session in late July 2017.
On 1 August 2017, the initial rules were made by the South Australian Minister for Mineral Resources and Energy. Future amendments to the rules will proceed under the regular Australian Energy Market Commission (AEMC) rule making framework.
Financial and weighted average price information
Under the framework, service providers of non-scheme pipelines are required to publish a range of information, including financial information and weighted average price information.
The GMRG released a consultation paper on the draft Financial Reporting Guidelines for Non-Scheme Pipelines and the financial reporting template in October 2017.
On 19 December 2017, the Australian Energy Regulator published the Financial Reporting Guideline for Non-Scheme Pipelines. Service providers of non-scheme pipelines that are not subject to an exemption are required to publish financial information and weighted average price information by 31 October 2018 or 31 January 2019 depending upon the service provider’s financial reporting period.
